Terms of Service

These Terms of Service (“Terms”) govern your use of The Business Doctor at thebusinessdoctor.app, operated by Ashley Matheson, a sole proprietor based in Newfoundland and Labrador, Canada (“we,” “us,” “our”). By using the service, you (“you,” “your”) agree to these Terms. If you do not agree, do not use the service.

What The Business Doctor is

The Business Doctor is an AI-powered diagnostic tool. A free 3-question pulse check produces a personalized observation about your business at no charge. Customers who purchase the paid diagnosis ($99 CAD, one-time) answer additional questions about their business, and a team of four AI “specialists” (CFO, Growth Lead, Operator, Strategist) powered by Anthropic's Claude AI model generates a personalized 90-day action plan, delivered on-screen and by email. Paid customers also receive up to 20 follow-up questions with the Strategist.

What The Business Doctor is not

The Business Doctor is not licensed professional advice. The output is AI-generated business analysis for educational purposes. It is not legal, financial, tax, accounting, investment, or any other kind of regulated professional advice.

  • We are not your accountant, attorney, CPA, financial advisor, fiduciary, or consultant.
  • No professional relationship is created by using this service.
  • For decisions with significant financial, legal, tax, or operational consequences, consult a licensed professional who knows your specific situation.
  • The AI models we use can produce confident-sounding statements that are wrong. You agree to verify any specific number, claim, or recommendation before acting on it.

You are responsible for your own business decisions. We are not.

Eligibility

You may use The Business Doctor if:

  • You are at least 18 years old
  • You have the authority to enter into these Terms
  • You operate a real small business (the consultation gate asks you to confirm this)

You may not use the service if you are running it as a test, a class assignment, a media exercise, or out of mere curiosity — the rate limit is in place to protect the integrity of the service for actual customers.

Free and paid tiers

  • Free pulse check: a 3-question quick read that produces a personalized observation about your business. Free, no email or card required, and may be run multiple times with different inputs. Subject to daily and monthly free-tier capacity caps on overall server usage.
  • Paid full diagnosis ($99 CAD, one-time): a guided 8-10 question interview with the Diagnostician, followed by analysis from all three specialists (CFO, Growth Lead, Operator), the Strategist's 90-day action plan, and up to 20 follow-up questions with the Strategist. Tax is added at checkout based on your location.

The paid diagnosis does not auto-renew. There is no subscription. One payment grants you one full diagnosis and one cohort of 20 follow-up questions.

Refund policy

The free pulse check lets you preview the analytical voice before you decide whether to pay. Because you experience the service before purchasing, paid diagnoses are final and non-refundable under normal circumstances.

We will issue a full refund if:

  • A technical error prevents your report from generating
  • You are charged twice for the same purchase
  • The service is materially broken and you cannot use what you paid for

Refunds for these cases are processed through Gumroad. To request one, reply to your Gumroad receipt or email support@thebusinessdoctor.app describing the issue.

Acceptable use

You agree not to:

  • Submit false or misleading information to manipulate the AI specialists' output
  • Use the service to abuse, harass, or harm others
  • Attempt to reverse-engineer the prompts, scrape the site, or otherwise circumvent the rate limits and security measures
  • Resell, redistribute, or commercialize the output as your own consulting deliverable to third parties — the report is licensed for use in your own business
  • Use the service for any unlawful purpose

We may suspend or terminate your access if we reasonably believe you have violated these terms, without refund.

Intellectual property

You retain ownership of the business information you share with us. We grant you a personal, non-exclusive, non-transferable license to use the generated report for your own business. The Business Doctor's prompts, code, design, and branding are our property and may not be copied or imitated.

AI-specific disclaimers

You acknowledge and agree that:

  • The output is generated by AI (Claude, by Anthropic) and may contain errors, omissions, or inaccuracies.
  • The AI specialists may use real-time web search to ground their analysis. Information returned by web search reflects what is publicly available at that moment and may be outdated or incorrect.
  • Specific dollar figures, percentages, and benchmarks in your report are estimates based on the answers you gave us. They are hypotheses for you to verify, not forensic accounting.
  • The AI can produce confident-sounding statements that are objectively wrong. You agree to verify before acting.

Limitation of liability

To the maximum extent permitted by law:

  • The service is provided “as is” and “as available” without warranties of any kind, express or implied.
  • We disclaim all warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
  • We are not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, or lost data.
  • Our total liability to you for any claim arising out of or relating to the service is capped at the amount you paid us in the twelve months before the claim arose (which for most users is $99 or zero).

Nothing in these Terms limits liability that cannot legally be limited, including any consumer-protection rights you may have under Newfoundland and Labrador or Canadian federal law.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the service.

Termination

You may stop using the service at any time. We may terminate or suspend your access at any time, with or without cause, with or without notice. After termination, any unconsumed unlock code may be invalidated.

Governing law and disputes

These Terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable in that province, without regard to conflict-of-law rules.

Before filing any formal claim, you agree to first contact us at support@thebusinessdoctor.app and attempt to resolve the dispute informally for at least 30 days.

Any unresolved dispute will be resolved exclusively in the courts located in St. John's, Newfoundland and Labrador, Canada. You consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.

Privacy

Your use of The Business Doctor is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information.

No guarantee of results

The Business Doctor provides analysis, observations, estimates, and recommendations generated using artificial intelligence. We do not guarantee any specific outcome, including increased revenue, profit, growth, funding, valuation, operational improvements, customer acquisition, cost reductions, or business success.

Any examples, benchmarks, forecasts, projections, financial estimates, or performance assumptions provided by the service are illustrative only and should not be relied upon as guarantees of future performance.

Customer responsibility

You are solely responsible for evaluating, verifying, and implementing any recommendation generated by the service. You assume all risks associated with decisions made using information provided by The Business Doctor.

Third-party services

The service relies on third-party providers, including AI model providers, hosting providers, email delivery services, analytics providers, and payment processors. We are not responsible for interruptions, inaccuracies, outages, delays, or failures caused by third-party services.

Payments

Payments are processed by third-party payment processors, including Gumroad. We do not collect or store your payment card information. Your payment information is subject to the applicable payment processor's terms and privacy policies.

Email delivery

Reports, receipts, unlock codes, and other communications may be delivered by email. We are not responsible for delays, delivery failures, spam filtering, inbox placement issues, or other email-related problems outside our reasonable control.

Data retention

We may retain consultation responses, generated reports, follow-up conversations, support communications, account information, and related records for operational, security, fraud-prevention, legal, compliance, analytics, and service-improvement purposes.

Force majeure

We are not liable for any delay, interruption, or failure to perform resulting from causes beyond our reasonable control, including internet failures, telecommunications disruptions, cyberattacks, AI provider outages, hosting provider failures, utility interruptions, labor disputes, natural disasters, government actions, public emergencies, or other force majeure events.

Beta and experimental technology

Artificial intelligence technology remains probabilistic and experimental. The service may generate incomplete, inaccurate, inconsistent, outdated, misleading, or otherwise imperfect results. You acknowledge and accept these limitations as an inherent characteristic of AI-generated content.

Changes to the service

We reserve the right to modify, suspend, discontinue, replace, or remove any feature, functionality, pricing, or aspect of the service at any time.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

Entire agreement

These Terms, together with the Privacy Policy and any policies referenced herein, constitute the entire agreement between you and us regarding the service and supersede all prior understandings or agreements relating to the service.

Consumer rights

Nothing in these Terms excludes, restricts, or limits any rights or remedies that cannot be excluded under applicable consumer protection laws.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top will change. Material changes will be communicated by email or a prominent site notice. Continued use after an update constitutes acceptance.
